Policy CS8 provides no specific guidance in relation to public art provided as part of, or associated with, canalside development. It does not appear to differ from the position that would apply to any new development, whether near a canal or not. The policy sets out no particular aims or aspirations that the Council has in relation to the provision of public art in canalside locations, and only “encourages” provision of public art. We therefore question whether Policy CS8 can be regarded as being justified or effective.

The policy should be strengthened to provide clearer guidance.
