In terms of housing delivery, we believe Draft Policy Direction 1 is too broad and lacks precision. It should be more certain of providing the number of homes required under the new standard method.
The wording of Draft Policy 1 must be amended such that the Local Plan will make provision for the delivery of at least 2,188 dwellings per annum not 1,679. The use of the HEDNA figures is not in accordance with Paras 36(a) and 62 of the NPPF which detail that “strategic policies should be informed by a local housing need assessment, conducted using the standard method in national planning practice guidance.” The current wording has not been positively prepared and is not considered to be sound
in accordance with Para 36(a).
We would question the assumed Windfall allowance over the plan period. This suggests 17% of housing need will come from windfall sites which is very excessive.
Regard should be taken to how the delivery of new settlements provides a more sustainable community and economy with the provision of new infrastructure, schools and amenities being included as part of such developments.
Under the new method the shortfall in delivery will then be carried forward into the next five-year period. Without the allocation of new settlements, the housing and employment land provision will risk being in deficit for a significant part of the plan period,
as such we would like to emphasise our client’s land’s availability, suitability and deliverability to deliver the significant housing numbers required by the new methodology which should be used

Potential Settlement Question G1

We strongly agree that New Settlement Location G1 should be included within the Local Plan. As set out above, the new NPPF methodology for calculating the required annual housing delivery states that SWLP accommodate at least 2,188 dwellings per annum.G1 is very sustainably located along the M40 motorway providing excellent access north to Warwick and Birmingham, and south to Oxford and London. The site is also in very close proximity to existing employment locations.G1 is located within Flood Zone 1, at the lowest risk from fluvial flooding. It is not affected by Ancient Woodland, green belt, an Area of Outstanding Natural Beauty, local nature reserves, site of special scientific interest, historic battlefields, conservation areas, listed buildings, scheduled ancient monuments or any other statutory planning designations or constraints. A public footpath runs along the eastern boundary of G1 which may be improved with new links as part of the development. As such, it is considered that G1 is a very suitable, available and deliverable location which can deliver a significant number of homes to those required during the plan period.

Yes, we agree with the approach laid out in draft policy direction 2 – potential new settlements. The Council states that one or more new settlements will be identified and considered for strategic site allocation in the most sustainable locations and where they can be developed to a suitable minimum size, recognising the importance of large-scale developments as set out in Paragraph 77 of the NPPF. We would like to emphasise the suitability of identified potential new settlement G1 for an allocation. Potential settlement locations A1, A2, B1, BW and C1 should NOT be included within the Local Plan due to them being located within the green belt when other suitable options are available and suitable to come forward outside of the green belt, such as G1. Including allocations for new settlements within the green belt when other suitable sites (G1) outside of the green belt are available risks the new local plan becoming unsound and as such should not be considered. New settlements in railway corridors should form an important part of the overall strategy as they will deliver housing and jobs over a long period of time, contributing not just to this Plan’s strategy but that of future Plans too, and would deliver highly sustainable new development where residents can either work close to their home, or travel by sustainable transport to work.

Site G1 has scored highly on the New Settlements HELAA (Part A) with red scores being limited to Transport (Amber/Red) and Call for Sites Coverage Rating (Red).It is stated that the site has scored Amber on Local Wildlife Sites, we would like to confirm that there are no local wildlife sites on or adjacent to G1 (including my client’s land) and as such the site should score Green.Part of the site is affected by surface water flooding, despite the site being located within Flood Zone 1 (that at lowest risk from
fluvial flooding). It is anticipated that as part of the allocation, strategic placement of housing in the areas not affected by surface water flooding will easily overcome this.The site is greenfield land; however, a large proportion of the site is grade 4 agricultural land, with the remaining land being grade 3, and as such would not result in the loss of the best and most versatile land. Lastly, the site has scored Amber/Red for Transport. The SWLP Strategic Transport and Education Assessment of New Settlement Options (WCC) considers that the site is not well served by cycling infrastructure despite the National Cycle Route 48 passing through the sit. We would also like to raise that G1 is located within the Road Opportunity Area 8 as identified by the West Midlands Strategic Sites Study 2024 and as such is a very logical location for a potential settlement in order to deliver these improvements.
It is noted that 3 or 4 new primary schools are needed for 6,000 new dwellings. Whilst G1 is providing circa. 5,360 dwellings, it is anticipated that either 1 or 2 primary schools will be required as part of the allocation. This would in turn provide a school within safe walking distance thus reducing active travel as a site constraint.
