Do you agree with the approach laid out in Draft Policy Direction 1 - Meeting South Warwickshire's Sustainable Development Requirements?

Draft Policy Direction 1 as drafted is not sound for the following reason:
a) It is not positively prepared as it does not seek to address the Joint Plan area’s housing needs.
To address these matters of soundness:
a) The Local Plan should cover a 25 year period from 1 st April 2025 to 31st March 2050 (which allows for a 15 year period from the anticipated date of adoption).
b) The housing requirement underpinning Draft Policy Direction 1 should be amended to be at least 54,700 dwellings(2,188dpa). In addition, allowance must be made within the Plan to accommodate the requisite quantum of unmet housing need arising from the City of Coventry and the City of Birmingham.
c) The sources of supply (especially commitments) should accurately reflect the position as at 1st April 2025, to omit any lapses and completions prior to this date. d) Further allocations should be added to the Plan which would include the allocation of our client’s land west of Southam Road, Kineton for around 160 dwellings (HELAA Ref: 452).

Do you agree with the approach laid out in Draft Policy Direction 2 - Potential New Settlements?

Whilst it is recognised that new settlements could have a role in contributing towards housing delivery, it is important that this does not undermine the wider requirements to ensure existing communities can thrive and grow, consistent with the advice in the NPPF. It is on this basis that the plan should include other sources of supply, both in the short and longer term, especially given the extended timeframe and realistic delivery rates from new settlements. Nevertheless, for clarity, we have no comments on the potential sites for new settlements.
The Plan therefore as currently prepared is not sound for the following reason: 1) It is not effective as it does not demonstrate how new settlements will adequately ensure sufficient delivery to achieve the minimum housing requirements in the NPPF.
To address this matter of soundness; a) Any provision for new settlements should both acknowledge the extended lead in times for new settlements alongside recognising that the plan should not hinder the ability of existing communities to grow and thrive throughout the entire plan period.

Do you agree with the approach laid out in Draft Policy Direction 3- Small Scale Development, Settlement Boundaries and Infill Development?

The proposed spatial strategy fails to recognise the important role of the current Main Rural Centres (especially Kineton) in seeking to accommodate housing growth (and other development (including employment)).
In discounting the role for larger scale development, it conflicts with the approach in NPPF paragraph 83, which emphasises the needs for communities to grow and thrive, which apply through the emerging plan period.
The Plan therefore as currently prepared is not sound for the following reason:
1) It is not justified as it fails to acknowledge that growth at places should exceed the infill and small scale development thresholds as currently state.;
2) It is not effective as it does not demonstrate how development plan policies confirm the suitability of locations for the proposal envisaged; and.
3) Not consistent with national policy is that it does not fully reflect the guidance in NPPF paragraph 83 for places to grow, especially where like the Main Rural Centres such as Kineton for a focus of existing services for the locality.
To address these matters of soundness;
a) That the draft policy direction must allow larger scales of development beyond infill and small scale schemes, with appropriate adjustments to settlement boundaries.

Do you agree with the approach laid out in Draft Policy Direction 4- Accommodating Growth Needs Arising from Outside South Warwickshire?

1. It is not justified as it fails to acknowledge that an uplift in the housing requirement is likely to be necessary to make a contribution towards unmet need in neighbouring authorities, including from the Cities of Coventry and Birmingham; and
2) Not consistent with national policy as it does not currently make a contribution towards unmet needs.
6.3 To address this matter of soundness: a) The Joint Plan area should include a contribution towards unmet needs arising outside of the Joint Plan area, including from the Cities of Birmingham and Coventry b) Additional allocations to be identified through the Local plan process, to include the allocation of our client’s land west of Southam Road, Kineton for around 160 dwellings (HELAA Ref: 452).

The land west of Southam Road, Kineton represents a development opportunity that could deliver substantial and wide-ranging public benefits. 7.50 The Site should be allocated for approximately 160 dwellings in helping to meet identified housing needs, in what is a sustainable location, within walking and cycling distance from local services and facilities at one of the most sustainable MRCs.
