The Council should not set a higher environmental target than those already set out by government, the Building Regulations and those set out in the Environment Act 2021. This includes ensuring that the Council does not require BNG above 10%. Any environmental target beyond the current legislation would need to be fully evidenced and justified and ensure it meets the requirements of paragraph 58 of the NPPF and in particular ensure that any requirement is ‘fairly and reasonably related in scale and kind to the development’.
