This approach is consistent with Paragraph 133 of the Framework. Catesby Estates intend to engage with the local community and other stakeholders through public consultation events to help influence the design of the Land South of Allimore Lane, Alcester development in support of a planning application, following the adoption of the South Warwickshire Local Plan. A site-specific design code will be developed for the Site in accordance with NPPF Paragraph 134. The accompanying Vision Document demonstrates that much work has already been undertaken into achieving a well-designed neighbourhood.
However, it is considered that the policy needs to respond to the particular individual circumstances of a site and not be overly prescriptive. There must be flexibility within the Design Codes and Local Plan policy to allow developments to come forward in circumstances where they are not strictly in accordance with all design criteria, particularly when balancing environmental or technical considerations.

We believe that there is room in the broader approach to new settlements and large urban extensions to commit to a design code (or more appropriate vehicle) for the delivery of community development work to ensure that these new developments have a plan in place from the outset to ensure that
parish/town councils are sufficiently skilled and resourced prior to the start of the development, to assist in steering its delivery, that sufficiently skilled capacity exists to ensure the establishment of a viable thriving community, with well managed community assets (playing fields, parks, village centre, G.P.s, community hubs, etc. etc.), participatory residents associations and other facilities as determined at the time. This plan should be in place before the development commences and resources should accompany this to enable viable and thriving communities.

Design Codes should however be prepared in consultation with promoters as key stakeholders, to ensure the code is proportionate and appropriate. Codes should support promoter’s objectives, where one site might be being delivered with a focus on GI and lower density development whereas another site might be being delivered at a higher density and seeking to support an off-site cultural asset.
A skeletal Design Code could form part of a Statement of Common ground prepared between the Councils and site promoters, applying the approach we have set out in responding to Policy Direction 5.
In all cases Design Codes should have regard to NDMP’s introduced through the Levelling Up and Regeneration Act 2023.

Cala supports the general approach to set principles for new development in an area. Cala recognises the provision for a series of design codes to cover a range of geographical areas with varying levels of detail. Cala considers the proposals to introduce design codes of varying detail e.g. more detail for smaller sites and more general design guidelines for larger, strategic sites appears to be a sensible approach.
It is important the design codes factor in a degree of flexibility for large sites, to ensure there is the ability to encourage innovative and high-quality designs, which can respond to different character areas. This is an approach that is being followed at Cala’s Long Marston Airfield Garden Village (LMAGV), where a specific LMAGV adopted Masterplan SPD has set a series of guiding design principles that are being developed in further detail as detailed planning applications come forward across the settlement

We support the preparation of site specific Design Codes as appropriate to help guide development. These should be developed in conjunction with the developers of the new settlements and strategic allocations.
It is, however, noted that it is advised that “most, or all,” sites specific Design Codes will not be in place until after the adoption of the SWDP. The preparation of Design Codes should not delay the preparation and submission of planning applications. If a Design Code is in place planning applications should be prepared to be inconformity with its guidance. It should not, however, be necessary for developers to wait for Design Codes to be put in place before submitting planning applications or prior to their determination. This approach could cause significant delays to the delivery of housing.

The Bird Group are supportive of the proposed use of design codes, this being consistent with Paragraph 133 of the NPPF. Once a Design Code is in place it is accepted that planning applications should be prepared to be inconformity with its guidance. It should not, however, be necessary for developers to wait for Design Codes to be put in place before submitting planning applications or prior to their determination; this approach could cause significant delays to the delivery of housing. This is an important consideration given the fact that there remains a degree of uncertainty as to when the proposed series of design codes will be available, and that site-specific design codes will not likely be adopted until after adoption of the SWLP.
At Paragraph 134 makes clear that while landowners and developers may contribute to the preparation of Design Codes prepared by local planning authorities, they may also choose to prepare design codes in support of a planning application for sites they wish to develop.
